Welcome to Tempo AI, operated by Bytefern Ltd ("Company", "we", "us", or "our"). By using our application, you agree to these Terms of Use. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using Tempo AI ("the App"), you agree to be bound by these Terms of Use and enter into a legally binding agreement with Bytefern Ltd. If you do not agree to these terms, please do not use the App.

2. Description of Service

Tempo AI is a fitness application that provides:

• AI-powered workout analysis and insights
• Integration with Apple Health to track your fitness activities
• Personalized training recommendations
• Goal tracking and progress monitoring
• AI coaching chat assistance

Free Tier

Tempo AI can be used without a subscription, subject to the following limits:

• Up to 10 AI coaching chats per week
• AI coach can reference up to 10 recent workouts per query
• Up to 2 detailed split analyses per week

Free-tier limits reset on a rolling weekly basis.

Tempo AI Premium

Premium subscribers receive significantly higher usage allowances, including expanded AI coaching chats, full workout history, and unlimited split analyses. Premium features are subject to fair-usage limits to ensure service quality for all users. These limits are generous and designed not to affect normal use. If you encounter a limit, it will reset at the start of the next calendar month.

Rate Limits

To maintain service reliability, all users are subject to rate limits on API requests. These limits are designed to prevent abuse and do not affect normal usage of the App.

3. Subscription and Payment

Tempo AI offers a premium subscription ("Tempo AI Premium"):

• Title: Tempo AI Premium
• Length: Monthly (auto-renewable)
• Price: As displayed in the App at the time of purchase
• Free Trial: New users may be eligible for a free trial period as displayed in the App. At the end of the free trial, the subscription automatically converts to a paid subscription unless cancelled
• Billing: Payment is charged to your Apple ID account at confirmation of purchase
• Renewal: Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period
• Cancellation: You can manage and cancel your subscription in your Apple ID Account Settings at any time. Cancellation takes effect at the end of the current billing period

4. User Responsibilities

You agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Not attempt to reverse engineer, hack, or compromise the App's security
• Not use the App to transmit harmful or malicious content
• Maintain the security of your account credentials

5. Health and Fitness Disclaimer

• Always consult with a healthcare professional before starting any new exercise program
• The AI-generated insights are suggestions only and may not be suitable for your individual circumstances
• Stop exercising immediately if you experience pain, dizziness, or discomfort
• We are not responsible for any injuries or health issues that may result from following the App's suggestions

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Tempo AI and are protected by copyright, trademark, and other intellectual property laws.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data, including health data from Apple HealthKit.

By using the App, you consent to:

• The collection and processing of your workout data
• The transmission of your data to third-party AI services for analysis
• The storage of your data on our secure servers

8. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We do not guarantee that the App will be error-free or uninterrupted
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the subscription in the past 12 months

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by:

• Cancelling your subscription through Apple
• Deleting your account through the App's settings

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Right of Withdrawal (EU/EEA Consumers)

If you are a consumer in the European Union or European Economic Area, you have the right to withdraw from a digital content purchase within 14 days of the transaction without giving any reason.

However, by confirming your purchase or starting your free trial, you expressly consent to the immediate provision of the digital content and acknowledge that you thereby waive your right of withdrawal. If you cancel during a free trial before it ends, no charge is made and no waiver applies.

To exercise the right of withdrawal (where applicable), you must inform us of your decision by a clear statement (e.g. by email to mail@bytefern.app). You may also cancel your subscription through your Apple ID Account Settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. If you are a consumer in the European Union or European Economic Area, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable local law.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
